Pursuant to the provisions of Article 24
Decree No. 123/2015 / ND-CP, in order to be re-granted the Marriage Certificate, you must satisfy the following conditions:
1. Birth, marriage and death certificates registered at competent Vietnamese agencies before January 1, 2016, but the civil status books and original civil status papers are lost, shall be re-registered. .
2. Applicants for re-registration of births, marriages and deaths shall have to fully submit copies of papers and documents with contents related to the re-registration.
3. The re-registration of births and marriages shall be effected only if the registration applicants are still alive at the time of dossier receipt.
A dossier for the re-registration of a marriage includes:
+ A declaration made according to a set form;
+) A copy of the granted marriage certificate, without a copy of the marriage certificate, must submit a copy of the dossier and personal papers containing information related to the contents of the marriage registration.
Agencies competent to re-grant marriage registration papers: The commune-level People's Committees of the localities where the marriage has been registered.
Once you get the marriage certificate again, you can do the divorce. In the absence of a Marriage Certificate, it will be considered invalid and the court may refuse to accept your application.
